The Role


The Counsel , RPS, provides legal support to the Lincoln Financial Group business segments that are responsible for providing Lincoln’s retirement plan products and services.  The focus of this role will primarily be on the tax and ERISA requirements applicable to the qualified retirement plans, 403(b), 457 and other deferred compensation plans. 

Responsibilities

Legal

  • Provide legal advice and support on the development and maintenance of Lincoln Financial Group’s retirement products and services, marketing, sales and distribution to new and existing clients and the legal and compliance aspects of servicing clients and their retirement plans
  • Identify and communicate legal exposure and risk in a timely and proactive manner to internal key stakeholders
  • Act as a “thought leader” who will be sought after for advice, counsel, and judgment
  • Draft and negotiate:
    • Service agreements with plan sponsors
    • Other contracts with investment, service and distribution partners
    • Settlement agreements with plan sponsors or participants
    • Other agreements as needed
  • Advocate Lincoln Financial Group’s position with third parties such as federal and state regulatory bodies and agencies
  • Oversee the production of legal research including the use of electronic, hard copy, and internet resources, as necessary
  • Effectively manage time sensitive projects across large multi-disciplined and cross functional teams
  • Direct outside counsel on various legal projects, as appropriate
  • Review documents and communications prepared for distribution to and/or use by employees and clients (e.g., marketing materials, administrative forms, website content)
  • Analyze and communicate changes/developments in the laws applicable to the retirement plans business unit (legislative, regulatory, case law)
  • Maintain current knowledge of legal developments and trends, assess the impact, and ensure that new trends/developments are appropriately incorporated in current/future advice and strategies
  • Carries out duties in compliance with all state and federal regulations and guidelines 
  • Complies with all company and site policies and procedures
  • Remains current in profession and industry trends
  • Makes a positive contribution as demonstrated by making suggestions for improvement and implementing improvements whenever possible and learning new skills, procedures and processes

 

Requirements
 

Education

  • Undergraduate degree
  • J.D. from an American Bar Association (ABA) approved school and a Member of the Bar in good standing is required

Experience

  • Minimum of 5 years’ experience as an ERISA attorney preferably either at a law firm or financial services company
  • Experience with state insurance laws and other securities laws within a retirement plan context, is preferred
  • Experience with the tax and ERISA requirements applicable to qualified retirement plans, 403(b), 457 and other deferred compensation plans
  • Experience with the ERISA requirements applicable to the financial services industry such as relevant prohibited transactions and exemptions
  • Working knowledge of computer based legal research and other legal systems.
  • In-depth understanding of corporate structure, client organization, and business and corporate protocol
  • Experience reading, interpreting and drafting documents written at the most sophisticated levels such as contracts, prospectuses, policies, and proposals
  • Experience in a financial services/insurance organization is preferred
  • Demonstrated ability to recognize and weigh business and legal risks, lead strategically and advance innovative solutions
  • Proficient with Microsoft Office Suite (Word, Excel, PowerPoint, &Outlook)
